Terms of Sale

1. Who you are buying from

yaatuber is sold by Ken Kais, trading as BuzzBeam, based in Queensland, Australia. You can reach us at ken@kenkais.com. In these terms “we” and “us” mean that seller, and “you” means the person buying.

Your card statement will show KENKAIS, not “yaatuber”.

2. What you get

A perpetual, non-exclusive, non-transferable licence to install and use yaatuber for as long as you like. It is a one-time purchase:

• There is no subscription and no recurring charge.
• You may install it on devices you personally own or control, for your own use.
• Recordings you make with yaatuber are entirely yours. We claim no ownership of, and no licence over, anything you create with it.

What you may not do

• Resell, sublicense, rent or redistribute yaatuber, or share your download access with people who have not bought it.
• Reverse engineer, decompile or attempt to extract the source code, except where the law expressly permits it despite this term.
• Remove or alter licensing or attribution notices.

3. Your licence is your email address

Access to downloads is tied to the email address you use at checkout. Keep it accurate, and keep access to that inbox. If you need to move your licence to a different address, email us and we will move it.

Because that address is the key to your downloads, do not share it as a way of giving other people the software.

4. Payment

The price is $99 USD, charged once. Payments are processed by Stripe. We never see or store your full card details: those go directly to Stripe, which is certified to PCI Service Provider Level 1.

Prices are shown in USD. If your card is denominated in another currency, your bank sets the conversion rate and may add its own fee, which we do not control and do not receive.

The price shown does not include any sales tax, VAT or GST. Where we are required to collect such a tax, it will be shown separately at checkout before you pay.

5. Refunds

We offer a 14-day money-back guarantee, and you keep your rights under the Australian Consumer Law regardless. The full detail is on the Refund Policy page, which forms part of these terms.

6. Updates and support

We provide support by email at ken@kenkais.com. We aim to reply within two business days, though that is a goal rather than a guarantee.

Updates released for your version of yaatuber are included. We may release a future major version as a separate paid product; if we do, your existing licence keeps working and is not withdrawn.

We may change or discontinue features over time. If a change removes something substantial that you paid for, that may be a failure of a consumer guarantee, and your rights in the Refund Policy apply.

7. Requirements

yaatuber runs on macOS (Apple Silicon and Intel) and Windows 10 or 11. It is your responsibility to check that your device meets these requirements before buying. If you buy and discover it will not run on your machine, that is squarely within the 14-day guarantee.

8. Liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Apart from those rights, and to the extent the law allows us to limit liability, our total liability for any claim connected to yaatuber is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including lost recordings, lost revenue or lost time.

You are responsible for keeping your own backups of anything you record.

9. Acceptable use

You must not use yaatuberto record people without the consent the law requires where you are, or to infringe anyone’s copyright or privacy. Recording law differs by country and by state; complying with it is your responsibility.

10. Ending the licence

We may withdraw your licence if you materially breach these terms, for example by redistributing the software. We will tell you why. If we do this for any reason other than your breach, we will refund you on a fair basis.

11. Changes to these terms

We may update these terms for future purchases. The version that applies to you is the one published when you bought, and the date at the top of this page tells you which that is. We will not apply a later change retrospectively in a way that reduces what you already paid for.

12. Governing law

These terms are governed by the laws of Queensland, Australia. If you are a consumer somewhere else, this does not deprive you of the protection of any mandatory consumer law that applies where you live.
